The DMCA provides protection against infringement by users so long as the host does not obtain any direct benefit from the infringement. In the case of Flickr, they do not profit from anyone embedding the image in their blog, in fact, they lose money.&lt;br&gt;&lt;br&gt;For Flickr, this isn't a concern, but it is one for the person who uploaded the image. They could still be held liable and, indeed, it is an infringement for them.
